MOBILE TERMS OF SERVICE

These Mobile Terms of Service ("Mobile Terms") govern your use of Cay'lah Boutique's SMS/text messaging program and mobile services. By subscribing to our mobile program, you agree to these terms in addition to our Privacy Policy and general Terms of Service.

1. SMS PROGRAM OVERVIEW

Cay'lah Boutique offers an SMS marketing program that delivers exclusive product drops, limited releases, early access notifications, order updates, and curated offers directly to your mobile device.

Program Features:

  • New arrival alerts and limited drop notifications
  • Exclusive early access to Heat and Grails collections
  • Personalized styling recommendations based on your tier
  • Order confirmations and shipping updates
  • VIP-only promotions and special events
  • Tier-specific content (Daily Drip, Flex Zone, Heat, Grails)

2. CONSENT & SUBSCRIPTION

Opt-In: By providing your mobile phone number and completing the opt-in process (via website form, checkout, keyword text, or other enrollment method), you expressly consent to receive recurring automated marketing and transactional text messages from Cay'lah Boutique at the mobile number provided.

Voluntary Participation: Consent is not a condition of purchase. You may make purchases without subscribing to SMS.

Age Requirement: You must be 18 years or older to subscribe, or have parental/guardian consent.

Message Frequency: Message frequency varies by tier and promotional calendar. Expect up to 8 messages per month. Frequency may increase during special events, limited drops, or seasonal campaigns.

3. MESSAGE & DATA RATES

Standard message and data rates may apply based on your mobile carrier plan. Messages may be sent using an automatic telephone dialing system. Check with your carrier for details on your specific plan.

4. SUPPORTED CARRIERS

Our SMS program is supported by major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, and others. Carrier coverage is not available in all areas, and service may be interrupted or unavailable from time to time.

5. OPT-OUT & UNSUBSCRIBE

How to Opt-Out:

  • Reply STOPENDCANCELUNSUBSCRIBE, or QUIT to any message to unsubscribe
  • You will receive one final confirmation message
  • Contact support@caylahboutique.com to unsubscribe via email

Effect of Opt-Out: Once you opt out, you will no longer receive SMS marketing messages. You may continue to receive transactional messages related to active orders. To resume, you must opt in again through our website or by texting START.

6. HELP & CUSTOMER SUPPORT

7. PRIVACY & DATA SECURITY

No Sale of Data: We will never sell, rent, or share your mobile number with third parties for their own marketing purposes.

Retention: We retain your mobile number for as long as you remain subscribed or as required by law. After opt-out, we retain records for compliance purposes only.

8. DISCLAIMER OF WARRANTIES

The mobile program is provided "as is" without warranties of any kind. We do not guarantee:

  • Uninterrupted or error-free service
  • Delivery of all messages (carrier delays, network issues, or device limitations may occur)
  • Compatibility with all devices or carriers
  • Availability in all geographic areas

9. LIMITATION OF LIABILITY

Cay'lah Boutique is not liable for:

  • Delayed, failed, or misdirected messages
  • Charges from your mobile carrier
  • Losses or damages arising from participation in the SMS program
  • Unauthorized access to your device or messages
  • Third-party carrier service interruptions

10. CARRIER LIABILITY

Mobile carriers are not liable for delayed or undelivered messages. Carriers reserve the right to terminate service to anyone who violates their terms or uses the service to transmit spam or other prohibited content.

11. PROGRAM MODIFICATIONS & TERMINATION

Our Rights: We reserve the right to:

  • Modify message frequency, content, or features at any time
  • Suspend or terminate the SMS program with or without notice
  • Remove subscribers who violate these terms or engage in abusive behavior

Notice of Changes: Material changes to these Mobile Terms will be communicated via SMS or posted on our website. Continued participation after changes constitutes acceptance.

12. PROHIBITED CONDUCT

You may not:

  • Use the program to transmit spam, harassment, or unlawful content
  • Share, sell, or transfer your subscription to others
  • Attempt to interfere with or disrupt the program
  • Use automated systems to subscribe multiple numbers

Violations may result in immediate termination and potential legal action.

13. INTELLECTUAL PROPERTY

All content delivered via SMS (text, images, links, promotional codes) is owned by Cay'lah Boutique or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without permission.

14. DISPUTE RESOLUTION

Governing Law: These Mobile Terms are governed by the laws of the State of Louisiana and the United States, without regard to conflict of law principles.

Arbitration: Any disputes arising from these Mobile Terms or the SMS program shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law.

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.

15. TCPA COMPLIANCE

This SMS program complies with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations. By subscribing, you provide express written consent to receive automated marketing messages.

16. SEVERABILITY

If any provision of these Mobile Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. ENTIRE AGREEMENT

These Mobile Terms, together with our Privacy Policy and Terms of Service, constitute the entire agreement regarding the SMS program.
